New amendments on social insurances system, pharmacies and town planning

ORDER NO. 130/2011 REGARDING THE AMENDING AND SUPPLEMENTING OF THE APPLICATION RULES OF  GEO NO. 158/2005 REGARDING LEAVE AND SOCIAL HEALTH INSURANCE.

In accordance with the provisions of the new legislation, the leaves contribution and the health insurance allowance, are based on the declaration of social contributions, income tax and the nominal record of insured individuals.

If the paid allowances exceeds the amount of the due contributions, the employers can request a refund on the difference but granted that the medical leave certificates no. 2 is submitted.

GOVERNMENT EMERGENCY ORDINANCE NO. 18/2011 ON AMENDING AND SUPPLEMENTING OF ART. II OF ORDINANCE NO.130/2010 AMENDING PHARMACY LAW 266/2008.

The main change brought by this ordinance refers to the extension until 1st May 2011 of the  term established for the settlement of applications regarding the issuing of the operating permit for pharmacies and drugstores, applications which were filed prior to 30 December 2010.

GOVERNMENT EMERGENCY ORDINANCE NO. 7/2011 AMENDING AND COMPLETING THE LAW NO. 350/2001 ON SPATIAL PLANNING AND URBANISM.

According to the new ordinance, starting with 1st January 2012, any urbanism documentation that aims the entering into legality of some buildings constructed without permits or that fails to comply with the building permit can not be initiated and approved.

Also, it is provided that the Prefect can request the canceling of the approval decisions for the urbanism documentations issued with the violation of the legal provisions only after the execution of a legality control or as a result of the notification submitted by the general inspector of the State Construction Inspectorate, chief architect or specialized central  authorities.
